Terms of Use

These terms are an agreement between you and 3D Reality Labs LLC (“we”, “us”), the company that publishes Beastie. By downloading or using Beastie you agree to them, and to our Privacy Policy. We have tried to write them to be read.

Please read Disputes in particular. If you are in the United States, it says disputes are settled by individual arbitration rather than in court, and that you give up the right to join a class action, unless you opt out within 30 days.

Who can use Beastie

You must be at least 13 years old. If you are under 18, or under the age of majority where you live, a parent or guardian must agree to these terms on your behalf and is responsible for your use of Beastie.

What Beastie is

Beastie is a general fitness game. It counts exercise repetitions using your phone's camera and lets you compete with friends.

It is not medical advice, and it is not a substitute for professional guidance. Plans in Beastie adjust to the reps the camera counted, not to your health or fitness, and any calorie figure is an estimate from a standard formula, not a measurement. Its form feedback is a game-accuracy feature — it exists so the count is fair, not to keep you safe. Nothing in Beastie is a diagnosis, a treatment or a judgement that an exercise is safe for you.

Your health and safety

Exercise carries a risk of injury, and occasionally of serious harm. Consult a qualified professional before starting any exercise, especially if you are pregnant, have a medical condition or an injury, or have not exercised for a while. Stop immediately if you feel pain, dizziness or shortness of breath.

You choose when, where and how hard to exercise. Make sure the space around you is clear, that your phone is placed securely, and that a challenge from a friend never pushes you past what is safe for you. You take part voluntarily and at your own risk, and, to the extent the law allows, you release us from claims for injury or loss arising from your exercise.

Your account

You get an anonymous account on first launch. You may link a real account — with Sign in with Apple on iPhone, or with an email sign-in link on either platform. You're responsible for what happens under your account, and for the accuracy of anything you share, including your handle.

Being decent, and playing fair

Your handle, your scores and the messages you pick for a duel are visible to other people. Don't use them for anything abusive, harassing, hateful or illegal, and don't choose a handle that impersonates someone or uses someone else's trademark. Don't cheat a duel — for example by pointing the camera at a video, or by tampering with the app — and don't copy, reverse-engineer or interfere with the app or our servers. We can remove content and suspend or delete accounts that break these rules. You can report and block other users from inside the app.

You keep ownership of what you put into Beastie. You give us permission to store it and to show it to the people you duel and to other users as the app works — for example, your handle and score on a rival's screen — for as long as your account exists.

Subscriptions

Some of Beastie is free: your first set, and answering any challenge that somebody sends you. Other features, including further sets, game modes, sending duels and rematches, and plans, need Beastie Pro; the app shows which before you start, and a result you have already earned is never locked. What is free can differ between versions of the app. Beastie Pro may begin with a free trial (currently 7 days); unless you cancel at least 24 hours before the trial ends, it becomes a paid subscription at the price shown when you started it. Beastie Pro is an auto-renewing subscription, sold through the App Store on iPhone and through Google Play on Android. Payment is charged to your Apple ID or your Google Play account at confirmation. It renews automatically unless cancelled at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours of the period ending. Manage or cancel in your Apple ID settings, or in the Play Store under Payments & subscriptions. Any unused portion of a free trial is forfeited when you buy a subscription. Refunds are handled by Apple or by Google, under whichever store's policy you bought under.

Our stuff

The app, its artwork, its mascot and its name belong to 3D Reality Labs LLC. We give you a personal, non-transferable licence to use the app on devices you own or control, for as long as you follow these terms. Your workout data belongs to you.

No warranty

Beastie is provided “as is” and “as available”. Rep counting is done by software watching a camera; it will sometimes be wrong, and a duel result is only as good as the count. To the extent the law allows, we make no warranties of any kind, express or implied, including that the app is accurate, uninterrupted, error-free or fit for a particular purpose.

Limits on our liability

To the extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of Beastie. Our total liability for any claim relating to Beastie is limited to the greater of what you paid us in the twelve months before the claim, or US$50.

Some places do not allow these exclusions or limits. Nothing in these terms limits liability that the law does not allow to be limited — for example, liability for fraud, or, where the law provides for it, for death or personal injury caused by our negligence — or takes away rights you have as a consumer that cannot be waived.

If a claim is caused by your conduct

To the extent the law allows, you agree to cover us (and our members and contractors) against claims, losses and reasonable legal costs brought by someone else that arise from your breach of these terms or from content you post. We will tell you about any such claim and let you take part in how it is handled.

Disputes

Talk to us first. Before starting any formal claim, email us at 3drealitylabs@gmail.com describing the problem and what you want. Both sides agree to try in good faith to resolve it within 60 days.

Which law applies. These terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-law rules. If you live in the European Economic Area, the UK or another country whose law gives you mandatory consumer protections, you keep those protections and may bring a claim in the courts where you live.

Arbitration (United States). If you live in the United States and a dispute is not resolved informally, it will be settled by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. Either of us may instead bring an individual claim in small-claims court if it qualifies. The arbitration may be held by video or in the county where you live.

No class actions. You and we may each bring claims only on an individual basis, not as a plaintiff or class member in a class, collective or representative action. If this waiver is found unenforceable for a claim, that claim is not arbitrated and goes to court instead.

You can opt out. You may opt out of arbitration and the class-action waiver by emailing 3drealitylabs@gmail.com within 30 days of first accepting these terms, with the subject “Arbitration opt-out” and the email address or handle on your account. Opting out does not affect anything else in these terms.

Where court cases go. Any dispute that is not arbitrated will be heard in the state or federal courts located in Colorado, and both of us agree to those courts' jurisdiction, subject to your consumer rights described above.

Apple and Google

If you downloaded Beastie from the App Store: these terms are between you and us, not Apple. Apple has no responsibility for the app or its content, no obligation to provide maintenance or support, and, to the extent the law allows, no warranty obligation beyond refunding the purchase price if the app fails a warranty that applies. We, not Apple, are responsible for handling any claim relating to the app — including product liability, legal or regulatory compliance, consumer protection and intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm you are not in a country subject to a US government embargo and are not on a US government list of prohibited or restricted parties. If you downloaded Beastie from Google Play, Google Play's terms also apply to your download and purchases.

Ending things

You can stop using Beastie and delete your account at any time, from Settings. We may suspend or end your access if you break these terms, or if we stop offering Beastie. The sections on health and safety, warranties, liability, claims caused by your conduct, and disputes continue to apply after that.

Who runs Beastie

Beastie is published by 3D Reality Labs LLC, a limited liability company registered in Colorado, United States. Reach us at 3drealitylabs@gmail.com — that address is read by a person and is the fastest way to get an answer about the app, your subscription or your data.

Changes and the rest

We'll update the date above if these terms change, and, before a significant change takes effect, let you know in the app or by email where we can. If you keep using Beastie after that, the new terms apply; if you don't agree, stop using it and delete your account. Changes never apply to a dispute we already know about.

If part of these terms turns out to be unenforceable, the rest still applies. If we don't enforce something straight away, we haven't given up the right to. You may not transfer these terms to someone else; we may transfer them to a company that takes over Beastie. These terms and the Privacy Policy are the whole agreement between us about Beastie.
